In consideration of being allowed to participate in activities and use the facilities and equipment at V&V Baseball LLC and Batters Eye

(the “Facility”), I, the undersigned, acknowledge, appreciate, and agree that:

 1. There are inherent risks associated with participation in athletic activities and the use of fitness equipment, including but not limited to serious physical injuries, permanent disability, and death.

 2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Facility, its employees, volunteers, or other participants.

 3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest staff member immediately.

4. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless the Facility, its officers, officials, agents, employees, other participants, and sponsoring agencies from any and all liability for injury, disability, death, or loss or damage to person or property, to the fullest extent permitted by law.

5. I understand that this waiver disclaims liability for ordinary negligence of the Facility and its staff.

6. I affirm that I am in good health and physically capable of participating in athletic activities. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any activities at this facility.

7. In the event of an emergency, I authorize the Facility to secure from any licensed hospital, physician, or medical personnel any treatment deemed necessary for my immediate care and agree to be responsible for payment of any and all medical services rendered.

8. I grant permission to the Facility to use my likeness in photographs, videos, or other digital media in any and all of its publications, including web-based publications, without payment or other consideration.

By signing this waiver, I acknowledge that I have read and fully understand its terms, and I am aware that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
